CA Gun Laws - Saiga ownership?

Recommended Posts

Can a resident of CA legally own a Saiga-12 AGP mag? I had no orders from CA on the first 1500 that I had shipped. The last couple hundred orders have had at least a dozen people from CA. I have not shipped any of them to CA. I have read where it is a class D felony to sell to a high capacity magazine (anything greater than 10 rounds). I have seen bill drafts and other websites where it states that there is a 5 rounds limit for a shotgun, but I haven't actually seen it in the CA penal code. Does anyone know?

Cali residents can own the mags. They can't own semiauto shotguns that use detachable mags. Mark

This is true. The mag has to have 10 or less capacity and it cannot be used in a semiauto shot gun. You are perfectly in the clear if you send them to CA as long as they are 10 rounds or less.

Hell, if they were even 10+, you could take them apart and send them in as parts. The person that you sent it to though would not be able to assemble them without violating the law, but it is perfectly legal to order hi cap parts.

If you ever have any legal questions about CA law, let me know. If I don't know off the top of my head, I can find out for you.

I am not a lawyer.

They might be legal to own, but the buyer most likely wants to use them in a Saiga.

There is an ethical conflict to sell them and not warn the buyer that they can not legally be used in their state.

Mech Tech handles their disclaimer as follows:

Legal Alert: This product for sale to California dealers under limited conditions only. Although the product of itself is legal, the resulting combination with a pistol frame becomes illegal under California law. Please contact Mech-Tech for details relative to dealer sales in CA. At this time we know of no other states where the combination is not legal but we caution everyone to become aware of relative state and local laws.
