Making the responsible party pay for medical costs, etc, is fair game, IMO. But $150K for biting down on a olive pit? I'm sure it hurt like a sonofbitch, but damn. Maybe he had gold teeth and needs them replaced? :lolol:

Ridiculous??? If they were JUST "pat downs", the governor wouldn't be filing suit. Governor Ventura is suing the TSA for unlawful sexual assault. That's a bit more than a "pat down" in my book...

Ridiculous??? If they were JUST "pat downs", the governor wouldn't be filing suit. Governor Ventura is suing the TSA for unlawful sexual assault. That's a bit more than a "pat down" in my book...

I dunno man, apparently the were labelled as pitted, yet he broke and destroyed his tooth on a pit. $150k isn't really all that much for multiple maxillofacial surgeries.

Sadly, this is why we can legitimately say the "Greatest Generation" has come and GONE.

 

They would have just dealt with it, while we will sue for being too stupid to NOT bite down on something that MIGHT be harder than our teeth.

 

As for Ventura, political ploy. Not saying he's not right, but that it comes off reaking of politics.

If the food was labeled as pitted, but was not, then I would say the cafeteria is in fact at fault. As stated above, an olive pit can do some serious damage, and $150k really isn't too bad considering the tremendous pain and medical expenses.

 

The whole "deal with it" thing sounds cool and all, but I'd like to see the people saying that put their money where their mouth is. Something tells me you wouldn't enjoy massive pain and three years salary worth of medical bills.

I have chipped my tooth before and it hurt like a son-of-a-bitch. These things usually settle out of court anyway, the idea is you present the offending party with a high $$$ figure and they eventually settle for less. Likely the cafeteria will end up paying the hospital bill and some compensation for pain and suffering. This is a good thing, not the end of America.

Jessee is suing because the asshats at TSA violate the Constitution and the ADA by groping anyone with metal implants in their body. If this allowed then you are wasting everyone's time and a lot of money to pay perverts to grope old people. Israel has much better 'security' and THEY don't grope!

Would they in any other case? How weak was his tooth to begin with? Why aren't THEY going after the restaurant that caused them to expend money? If his tooth was that weak and faulty to begin with, why is anyone but he and his dentist responsible? An olive pit isn't a handgrenade. This is not gross negligence, or a vicious attack.

 

My basic point is, they should pay for the dental work. Not for some punitive damage because they have the smallest legal fund to defend themselves. This is simple extortion by lawyer.

 

I highly doubt they grew the olives, or even pitted them. But I also doubt a small food service company can afford to defend one lawsuit, and press one more frivolous suit against their supplier.

 

The rest of the customers and workers will end up covering this cost.

Guys do not get me wrong, I do agree that there are too many frivolous suits in America....But If I was seriously damaged because of someones neglect, I wouldn't want to have to pay for it. I am sure he is rich and can afford it, but he has no reason to expect pits to be in the food and wrecked his tooth on one.

 

Almost akin to something saying no peanuts, and then you having an allergic reaction to the peanuts they slipped in and needing medical attention. You had no reasonable expectation to know it was in there but it was anyway.

As glad as I am that the generation of men drafted to fight Imperial Japan and Nazi Germany were willing to show up for duty instead of being hauled off to Leavenworth KS I must say that they are the very pricks who saddled us with the mess we are in today. They rode their Golden Parachutes right down to the grave and made sure there was nothing left for us. they voted themselves entitlements and kept the democrats in power until they started dying off and are only slightly more responsible to the future that the damned Baby Boomers.

 

This "Greatest Generation" shit has got to have some limits because the great depression era folks were a damn sight more pragmatic and leery of the giant all consuming shitball our nation has become and I would call them the Greatest Generation if the name wasn't already applied to their kids.

But how do you tell Grandma and dad that they can't have Social security and free drugs for life just because they voted for it? These people have been told from day one the Government can do anything, and give anything, to anyone who votes for it. They honestly think Government produces money, food and wealth to be handed out. They don't understand that doesn't produce ANYTHING.

 

It's like telling a 5 year old there is no Santa Claus while a guy in the suit is standing in front of them.

My first reaction to this story was "What a PUSS." Seriously, then, just last night, we went to our favorite Italian restaurant. About three quarters of the way through a Stromboli, I bit down and hit something I thought was a bone. Luckily, I had only bitten down lightly. I politely, as any civilized gentleman would do, extracted it from my mouth. It was not a bone, it was a one inch bolt. Yes, a metal bolt, likely from the mixing machine.

 

 

I was lucky, in that I had not 'chomped" down hard on the bolt. However, a bolt is a much different thing than an olive pit. A bolt is a "foreign" object, not generally expected to be found in our food. An olive pit is considered a "natural" item, something which could be found in our food. At least when I took my Torts class in law school a long time ago, that difference was significant in the likely success of a cause of action for negligence with regard to the preparation or presentation of food in a commercial enterprise.

 

Anyway, back to the Stromboli with mushrooms, sausage, green peppers and bolts. I called the owner over and told her what I found. She was apologetic and removed the Stromboli from our bill. That was all I expected and all that was appropriate. With hindsight, however, if I had fractured my tooth, I believe I would have expected, at a minimum, that my dental bill be covered.

 

As you know, dental pain is rather unique. We all hate it and should not be subjected to it merely because we are trying to fuel our metabolism. So, after last night, I have softened my position on this topic and I have more sympathy and empathy than I did yesterday morning. If I sued the restaurant for $150,000.00 it would not be news. Maybe, this too, should not be news. I sometimes think we are, in this internet age, exposed to too much news, and too many things that really are not truly "news worthy."
