    • Yes, i would go through the NFA paperwork to have my S-12
    • Yes, i would go through the NFA paperwork to have my S-12... but only if the $200 tax stamp was waived.
    • Yes, and since its now a DD, might as well make it a SBS
    • No, I would sell it because my state doesn't allow DD's
    • No, I would sell it because I don't want to deal with the hassels of the NFA
    • Willing to support a class action lawsuit against the ATF or other legal means to attempt going to the Supreme Court and having the sporting clause overruled

I know in IN you can own a destructive device but cannot own a SBS..........not sure how it would work here.

 

Once it's a DD it's no longer a shotgun therefore no matter the barrel length, it could NEVER be a short-barreled shotgun because it's not a shotgun anymore.

 

It would technically be a Short Barreled-Destructive Device, which falls under DD...

 

Thats according to federal law though. In indiana they declared SBS by a certain type of terminology that doesnt care if its a DD or not. So you still couldnt shorty it in Indiana (which otherwise has great gun laws. I miss my home state : /)

 

For Indiana types -

IC 35-47-1-11

"Shotgun"

Sec. 11. "Shotgun" means a weapon designed or redesigned, made or remade, and intended to be fired from the shoulder and designed or redesigned and made or remade to use the energy of the explosive in a fixed shotgun shell to fire through a smooth bore either a number of ball shot or a single projectile for each single pull of the trigger.

As added by P.L.311-1983, SEC.32.

 

IC 35-47-1-10

"Sawed-off shotgun"

Sec. 10. "Sawed-off shotgun" means:

(1) a shotgun having one (1) or more barrels less than eighteen (18) inches in length; and

(2) any weapon made from a shotgun (whether by alteration, modification, or otherwise) if the weapon as modified has an overall length of less than twenty-six (26) inches.

As added by P.L.311-1983, SEC.32.

 

IC 35-47-5-4.1

Sawed-off shotgun

Sec. 4.1. (a) A person who:

(1) manufactures;

(2) causes to be manufactured;

(3) imports into Indiana;

(4) keeps for sale;

(5) offers or exposes for sale; or

(6) gives, lends, or possesses;

any sawed-off shotgun commits dealing in a sawed-off shotgun, a Class D felony.

(B) The presence of a weapon referred to in subsection (a) in a motor vehicle (as defined under IC 9-13-2-105(a)) except for school buses and a vehicle operated in the transportation of passengers by a common carrier (as defined in IC 8-2.1-17-4) creates an inference that the weapon is in the possession of the persons occupying the motor vehicle. However, the inference does not apply to all the persons occupying the motor vehicle if the weapon is found upon, or under the control of, one (1) of the occupants. In addition, the inference does not apply to a duly licensed driver of a motor vehicle for hire who finds the weapon in the licensed driver's motor vehicle in the proper pursuit of the licensed driver's trade.

© This section does not apply to a law enforcement officer who is acting in the course of the officer's official duties or to a person who manufactures or imports for sale or sells a sawed-off shotgun to a law enforcement agency.

All of this is hilarious/asnine considering you can have SBR, machineguns, and AOWs... but not SBS

From my understanding, and I could be wrong, once its a "DD" its no longer considered a shotgun so length limits no longer limit you, on the flip side if your states have laws against SBS then you still might not be able to cut it down. (not legal advice)

 

In WA (state), we can have DD's but not SBS's (shucky darn)

I would imagine they would be grandfathered for current owners. Yes, I'd do the paperwork instead of burying it. Some folks here would rather risk a Federal Weapons charge huh? "Meet Bubba, your new cellmate and most dominate male in the cellblock". Hope you enjoy your stay! :)

I agree, I mean, hell, it's only a little bit of paperwork, and it's free. Even if it isn't free, it's $200 per weapon which, with all that it entails, is cheap for what you're getting in the end.

 

Besides, for those of us who have multiple S-12s, you can do the paperwork and pay the taxes on all of them, then turn around and sell one for what you've got in the taxes and maybe even a couple of S-12s...

what s-12? :angel: lol im not paying to keep a weapon i already payed for and correctly registered!you guys that do are just giving the goverment more power to take our beloved weapons away and now when they come around to collect them when the shit hits the fan guess whos house they will come to first :cryss: mine will be hidden where they cant find it lol

You can. Then you go to jail. So I wouldn't do that.

 

In fact you are required to report lost/stolen NFA weapons to the ATF iirc.

1.YES,i did register my weapon because i live in nj and have to fill out a pile of paper work for every gun i own and when im done i get a piece of paper to show that fact when im done,i know that not every state is like that and that there is no "official registering system" but you would be stupid to think that the goverment couldnt find out in a split second how many and what kind of weapons u have :blues: also please dont assume i dont know what i am talking,you dont know me :rolleyes:

They don't know, and can't, it's impossible, yes, they'll know that I have two Saiga-12s, a Mosin Nagant 91/30, and a Mossberg pump. Everything else they have no way of knowing unless they break into my house.

No, I would prefer the unconstitutional NFA be repealed. Then we'd have no need for an agency to enforce it.

As far as I am concerned the BATFE is a criminal organization whose only purpose is to infringe on the 2nd Amendment and on occassion murder American Citizens in remote cabins. These Jack Booted Thugs should find other work and leave Law Enforcement to actual Law Enforcment professionals.

Yes, I think so. The FBI behave like adults and professionals for the most part, not a bunch of over-reaching kittenstompers who pull deadly publicity stunts as a means to gain more taxpayer money and power. I'd rather deal with the FBI any day.

 

Only problem is, if the FBI took on the BATF's duties, they would also have to take on BATF's agents, and the FBI has made it clear they do NOT want them.
