Now if this was any other John & Jane Citizen, there would be Charges filed, Lewd Behavior, Indecent Exposure and others come to mind. Forced to be on the Sex Offender Registry for the rest of our lives. As of right now, for this Officer... Nothing. I wonder if she was trying to get out of a ticket? Yes, There may be a relatively reasonable explanation to this, but even if it was his wife/GF and he was off duty, he's still using a patrol car and a full uniform not worthy of a crime but defiantly needs to be fired, just for the fact that he's stupid enough to do it in front of a camera. Besides, its got to be against department policy to use a patrol car a full uniform while off duty, although i could be wrong. I suppose it could be a "low-profile" traffic car, but I think being pulled over by a Honda Accord would be considered "cruel and unusual" in this country. If it turns out that he was on duty at the time, then he deserves whatever internal disciplinary measures are called for by his agency. If this was a sexual favor for preferential treatment, then termination would seem in order. I don't know what the department's policy on off-duty uniform wearing is, but that may be a violation as well. If, however, he was not forbidden from wearing his uniform home, was off duty at the time, and was only seen by the state's cameras, I'd have a hard time figuring out what charges to press. 1 Quote Link to post Share on other sites

I was with a girl in a mosk's lower parking lot in the middle of the night years ago & it was too cramped in the car so I did just that. A little over a month later I see a news story that they arrested 7 arabs ("The portland 7") that were trying to set up a terrorist training camp in a rural area & that they met regularly at that mosk. Urinating in Public + Public Indecency + Lewd behavior = $1000.00 + Court Costs, 6 months probation and Sex Offender status. Unless you contend she didn't swallow and the abandoned ranch that hosted their tryst was a major but narrow thoroughfare that is used for both pedestrian traffic and conducting business. Now, I'm guessing here, but I don't think the Santa Fe Canyon Ranch is a major, urban institution. I'm no expert on rural land use, but the word "ranch" in the name strikes me as indicating vast, open spaces populated by more rattlesnakes than children. Even when the ranch was occupied, I doubt the local population density was much higher than one person per couple hundred acres. What we are left with is two people having consensual sex in a place they weren't not allowed to be and failing to create a health hazard. The fact that they were recorded by a police camera is immaterial. The camera was placed there to gather evidence of criminal activity. It captured a lawful but ill-advised activity that only came to the public's attention after media exposure. That said, I don't think urinating in public should be considered a sex offense unless the actor is doing it to gain some sort of sexual arousal. Your friend, Chile, seems to have gotten hosed in an attempt to make an example of public urinators in a city where and at a time when that sort of thing is a larger problem than generally. NM State Police, Albuquerque Police Department, Rio Rancho Police Department, Bernalillo County Sheriff all issue take home cars. Probably more than that, but I know they do. They limit how for you can drive home off-duty but the car is classified as a benefit of the job. I know a NMSP guy who's initial post was 90 miles from his house, so he parked his car in the lot of an tribal police department and every day he left his cop car there and drove home in his pov. It doesn't take a very high percentage to result in a continuous stream of bad news. APD has had a couple of cops who were running some sort of car theft operation and murdered one of their wives to cover it up. They also had a cop who raped a chick after arresting her.
