But President Obama's pick to replace him is Loretta Lynch, and her confirmation could move fast.

If the idea of a U.S. District Attorney coming straight from the gun control bastion of New York City concerns you, then I hope you'll take action.

That's because if your Senators don't ask Ms. Lynch the tough questions, we might end up with yet another gun-grabbing Attorney General.

Today, the 114th session of Congress began, and one of the Congressional Republican Leadership's purported top priorities is to block President Obama's executive action amnesty.

Unfortunately, the leadership has shown little desire to truly tackle and derail the amnesty and has simply allowed individual members to offer individual bills that have no hope of being signed into law.

If Republicans truly want to push back against the Obama amnesty, they need to include language that defunds Obama's amnesty in the upcoming, must-pass DHS appropriations bill.

Will Congress give Obama unilateral power to ban guns?

 

In “fast track,” Congress passes a bill which delegates to Barack Obama the legislative authority to do anything he wants -- ABSOLUTELY ANYTHING -- so long as he includes it in a “trade agreement.”

In this case, the trade agreement is the Trans-Pacific Partnership agreement (TPP or TPA) -- currently being negotiated with thirteen Pacific Rim nations.

The problem is that Congress would delegate this authority to Obama without knowing what was in the top secret agreement -- and possibly before it is even completely written.

Gun import bans?  Does anyone want to bet that Barack Obama would resist the temptation to sneak these into the TPA?  And, if he does, the agreement must be voted on “up-or-down,” with no amendments and no possibility of a Senate filibuster.  And every word of the agreement would have the force of law.

This President has used his Executive “pen,” time and time again, to circumvent the Congress and the Constitution.  Giving him this “fast track” authority is extremely dangerous. And things will only get more difficult when every Establishment interest in Washington starts pushing Congress to immediately approve this “up-or-down” deal. 

We saw, with the anti-gun Cromnibus last month, how difficult it is to stop legislation under these circumstances.  So this is another one of those cases where Congress is being told to pass something “so we can find out what's in it.”

Please contact your Senators and Representative.  Ask them to oppose giving unbridled “fast track” authority to Barack Obama.

Urge your Senators to oppose the Loretta Lynch nomination for Attorney General. 

Like many of her predecessors before her -- such as Justice Sonia Sotomayor and Attorney General Eric Holder -- Lynch comes from the far, far Left.  (Lynch's chief patron was New York anti-gun zealot Charles Schumer.)

Like Lynch, Justice Sonia Sotomayor had schmoozed the Judiciary Committee, claiming under oath that she was open-minded about the Second Amendment. 

But as soon as she was confirmed, she made it clear, in an opinion that did not require her views on the issue, that she believed the Heller case should be reconsidered. Obviously, Sotomayor had never been open-minded about the Second Amendment; she had, instead, lied under oath.

Sadly, the writing is on the wall, and Loretta Lynch will probably be confirmed as Attorney General.  But it’s important, nevertheless, for Americans to urge Senators to oppose the Lynch nomination.

Will Republicans Repeal one of the Most Devious Anti-gun Laws on the Books?

 

Remember ObamaCare?  That's the anti-gun “Obamanation” that feeds information on gun ownership into a federally run health database. 

The original law prevented doctors from doing this, but then Obama’s lawless Executive Action #16 in January of 2013 effectively (and unilaterally) repealed this prohibition on doctors asking their patients about guns in the home.

ObamaCare also opens the door for the ATF to troll that database in order to impose gun bans on millions of Americans with mental disabilities -- in much the same way that the Veterans Administration has disarmed almost 200,000 law-abiding veterans.

“As odd as it seems, ObamaCare contains provisions that jeopardize gun ownership, especially for veterans,” says TownHall columnist Rachel Alexander.  And it’s organizations like Gun Owners of America, she says, that “continue to expose these sneaky backdoor attempts at gun control.”

Marco Rubio Introduces Bill to Destroy Operation Choke Point

 
About a year ago, the Second Amendment community was rocked by news that the Federal Deposit Insurance Corporation (FDIC) had teamed up with Attorney General Eric Holder to utterly destroy firearms manufacturers and dealers by cutting off all credit and banking relationships with them.
 
For its part, the FDIC categorized gun and ammunition sales as a "high-risk business," lumping it in with drug dealers, pornographers, and Ponzi scheme operators -- all of which it was working to completely destroy.
 
So now, Senator Marco Rubio (R-FL) has introduced legislation to shut the doors of Operation Choke Point.  Rubio's bill, S. 477, would defund Operation Choke Point -- permanently.  It would insure that the FDIC didn't use "fees" to fund a program which could no longer go on with appropriated funds. And it would prohibit the Attorney General and the FDIC from reestablishing "Choke Point" under another name.
 
Furthermore, Rubio is committed to not just allow his legislation to lie dormant.  He understands that he may have to add the proposal as an amendment to a must-pass bill.  This is exactly what we will need to overcome a potential presidential veto.

Oppose 5.56 M855 Ball Ammunition Ban  

 

The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) has announced it is seeking to ban commonplace 5.56 M855 ball ammunition as "armor piercing ammunition." ATF is seeking public comment on the proposal, so all industry employees, target shooters and gun owners should contact ATF to oppose this unnecessary ban, which is truly a solution in search of a problem and that raises serious questions about executive agency attitude and overreach. Stopped cold on Capitol Hill, this action appears to be the Obama administration's attempt to pursue gun control by other means.

 

Commonly available steel-core, "green tip" M855 and SS109 rifle ammunition that is primarily intended and regularly used for "sporting purposes," like target shooting, has been exempt from federal law banning armor piercing ammunition for decades. There is no question that the 5.56 ball ammo has been in wide use by law abiding American citizens for sporting purposes.

 

It is with the increasing prevalence of handgun versions of rifle platforms, that ATF now apparently sees an opening to now ban the widely used M855 and SS109 ammunition.

 

It would be legally permissible to continue to possess and use so-defined "armor piercing" ammunition currently possessed. However, rescinding the decades-old exemption will have a major impact. It will become illegal to manufacture, import, distribute or sell at retail this very popular rifle target ammunition.

 

ATF's proposed "framework" for applying the "sporting purpose" exemption test rewrites the law passed by Congress to disregard the manufacturer's intention that a projectile or cartridge is "primarily intended for a supporting purpose." ATF inappropriately places the focus on how criminals might misuse sporting ammunition in a handgun.

 

Just as disturbing, language used by ATF in its long white paper refers to criminals as a "consumer group." The implication that the industry purposely sells firearms and ammunition to criminals is misleading and echoes the shopworn charges of the gun control lobby.  

 

Manufacturers will face serious limitations in their ability to develop and market alternative ammunition in other popular hunting rounds, such as .308 rifle hunting ammunition, if ATF's so-called "framework" is adopted. This will have a detrimental effect on hunting nationwide, especially in California where a total ban on traditional ammunition for hunting is being phased in now.  

 

ATF is soliciting comments on how it can best implement withdrawal of this exemption while "minimizing disruption to the ammunition and firearm industry and maximizing officer safety". Under the proposed framework, 30-06 M2AP cartridges would continue to be exempt because there are no multi-shot handguns generally available that accept such ammunition.

 

The proposal is useless since standard lead-only 5.56 ammunition is "armor piercing" simply due to the round's velocity. Rifles in this caliber, or any caliber for that matter, are rarely used in crimes.  

 

ATF will accept comments on this proposal until March 16, 2015. Email or write ATF today and tell them you oppose this unnecessary, misguided and damaging ban on commonly used ammunition for America's most popular sporting rifles.

ATF Seeks to Suppress AR-15’s by Banning Common AR-15 Ammo

 
The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) is proposing to illegally suppress the AR-15 by banning SS109 and M855 ammunition for that rifle as “armor piercing ammunition” under a 1986 statute banning certain types of ammunition -- a statute which amended the Gun Control Act of 19
 
The bottom line:  SS109 and M855 “green tip” ammunition -- with a traditional lead core and a steel tip -- does not fit within the two-part test required by the armor piercing bullet ban.  Rather, this is an illegal attempt to ban or limit AR-15's by banning types of AR-15 ammunition.
Moreover, any particular ammunition can be, and has been, exempted if it has a sporting purpose. Well, according to surveys, the AR-15 is used for target shooting or hunting over 50% of the time -- thereby, making its ammunition easily fit within the “sporting purpose” test, no matter what the composition of the ammunition.

Urge your Senators to do everything in their power to “defund” or overturn the ATF’s ban on SS109 and M855 “green tip” ammunition.

Also, urge them to hold up the nomination of Attorney General Nominee Loretta Lynch until the ATF backs down from its unlawful gun ban.

I contacted ours today thanking them on opposing the M855 ban...and asked them to work on getting rid if the $200 stamp and restrictions on suppressors, sbrs and sbs's. Probably won't go anywhere, but you won't get what you don't ask for.

And it's not about mooching the $200; rather the fact of red bastards "databasing" me for possible blacklisting and "gear" confiscation.

Let it be covered by the Concealed Carry permit or such, plus individual ID-ing/tagging of the weapon, but putting me into their "books" makes me cringing...

Should outlaw from banning bullets, or any components, the EPA and any other gov't org that tries to take the authority to ban bullets and not just the ATF.... not worded the best, but hopefully you see what I am getting at...

 

I hope they also remove surpressors from the tax and restriction NFA scheme...SBR as SBS would be nice too, but I won't hold my breath....

Strong response from my "rookie" US Senator Thom Tillis.

I was skeptical about him being the "big ol' GOP" man, but like what I see so far. Still, being watchful of his allegiances.

 

 

Thank you for taking the time to share your thoughts concerning the nomination and confirmation of Loretta Lynch as United States Attorney General.   I appreciate hearing from you and welcome the opportunity to respond.

 

I have immense respect for Loretta Lynch both personally and professionally. However, in light of the testimony at her confirmation hearing and her subsequent refusal to provide straightforward answers to written questions from myself and other Senators, it appears that she would represent little, if any, tangible policy or management difference from Attorney General Eric Holder.  I cannot vote to confirm a nominee who will not make a firm and explicit commitment to reverse the partisan politicization that presently exists at the Department of Justice.

 

Ms. Lynch also made it clear she supports President Obama's plan to grant amnesty to illegal immigrants on a wholesale basis without Congressional approval.  The President himself previously and frequently stated he lacked the constitutional authority to unilaterally implement such changes to immigration law and that Congress would need to pass it first.  In addition, Ms. Lynch has repeatedly sidestepped questions about prosecutorial misconduct at the Department of Justice.

 

For these reasons, I will not be voting to confirm Ms. Lynch.  In the event that she is confirmed by the Senate, I stand ready to work with her on key areas of agreement, and I hope she will prove my concerns unfounded by rebuilding the Department of Justice's fractured relationship with Congress, put an end to the costly and politically motivated ligation against North Carolina, and most importantly, restore the Department's reputation for legal integrity that is divorced from politics.

 

Again, thank you for taking the time to contact me.  It is important to hear from citizens themselves on issues that affect the state and the nation.  Please do not hesitate to get in touch with me again about other important issues.

NO Executive Gun Control!

 

NO Executive "Legislation" Whatsoever!

 

The Constitution for the United States clearly expresses in Article I, Section 1 that, “All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives.”

 

This said, any effort by Obama to craft “executive legislation” – via executive order, executive action, or executive memoranda – is unconstitutional, lawless behavior that you and your fellow legislators must aggressively challenge.

 

To do this, the following actions must be taken for each case:

1) As an immediate solution, you and your colleagues defund any executive effort that seeks to “make law” apart from the U.S. House of Representatives and Senate; and,

2) As a permanent solution, you and your colleagues pass legislation to nullify any executive effort that seeks to “make law” apart from the U.S. House of Representatives and Senate.

 

I expect you, a member of the United States Congress, to combat all instances of executive overreach and defend the Separation of Powers that the nation's organic law -- the Constitution for the United States -- prescribes.

 

I am watching your actions closely.

 Contact your congressmen and women and urge them to support H.R. 1466, the Surveillance State Repeal Act!

 

Surveillance State Repeal Act (H.R. 1466) introduced by Rep Mark Pocan (D-WI), would substantially scale back the surveillance apparatus of the U.S. government.

Nicholas Sarwark, LP Chair said, “The Surveillance State Repeal Act would dramatically improve the privacy of Americans’ personal and business communications and restore substantial Fourth Amendment rights now routinely violated by the U.S. government.”

The New York Times editorial board endorsed an earlier version of the bill, stating that it “deserves full Congressional support.”

The Surveillance State Repeal Act would:

  1. Repeal the PATRIOT Act (which contains the telephone metadata harvesting provision).
  2. Repeal the FISA Amendments Act (which contains the email harvesting provision), with the exception of the provisions regarding FISA court reporting and WMD intelligence collection.
  3. Make retaliation against federal national security whistleblowers illegal and provides for the termination of individuals who engage in such retaliation.
  4. Ensure that any FISA collection against a US Person takes place only pursuant to a valid warrant based on probable cause (which was the original FISA standard from 1978 to 2001).
  5. Retain the ability for government surveillance capabilities to be targeted against a specific natural person, regardless of the type of communications method(s) or device(s) being used by the subject of the surveillance.
  6. Retain provisions in current law dealing with the acquisition of intelligence information involving weapons of mass destruction from entities not composed primarily of U.S. Persons.
  7. Prohibit the government from mandating that electronic device or software manufacturers build in so-called “back doors” to allow the government to bypass encryption or other privacy technology built into said hardware and/or software.
  8. Increase the terms of judges on the Foreign Intelligence Surveillance Court (FISC) from seven to ten years and allows their reappointment.
  9. Mandate that the FISC utilize technologically competent Special Masters (technical and legal experts) to help determine the veracity of government claims about privacy, minimization and collection capabilities employed by the US government in FISA applications.
  10. Mandate that the Government Accountability Office (GAO) regularly monitor such domestic surveillance programs for compliance with the law, including responding to Member requests for investigations and whistleblower complaints of wrongdoing.
  11. Explicitly ban the use of Executive Order 12333 as a way of collecting bulk data, which pertains to the collection and storage of communications by U.S. persons.

Massie Bill Would Keep Our Kids Safe

 

Patriot, 

It’s become a world-wide problem:  A university in Kenya where 147 students were recently gunned down.

A newspaper publisher in France where over 20 people were either murdered or injured.

Or the long list of schools in the United States where unarmed students and teachers alike are relegated to the status of “sitting ducks,” while armed gunmen -- who ignore laws banning guns -- carefully and methodically execute innocent people.

Colorado state representative Patrick Neville (R-Castle Rock) knows something about school shootings.

 

You see, Neville was a student at Columbine High School on April 20, 1999.  On that tragic day, two disaffected students killed 13 unarmed victims, and injured more than 20 others.

The victims included students and teachers, boys and girls, but all of them had one thing in common:  They were shot down like “sitting ducks” in a gun-free school zone -- a place where teachers and staff were prohibited by law from defending their lives and the lives of their students.

Clearly, the fact that Columbine High School was a “gun-free zone” didn't mean that Columbine would be free of guns.  It only meant that the “good guys” wouldn't have guns.

 

Columbine survivor supports armed teachers

Roughly fifteen years after Columbine, Neville recounted that fateful day

[The] teachers and faculty [at Columbine] were heroic in many ways that day.  That's why I truly believe [if] some of them had the legal authority to be armed, more of my friends would still be alive today.

But the tragic situation which killed 13 defenseless victims at Columbine could change soon.  Pro-gun Congressman Thomas Massie (R-KY) has introduced H.R. 86, which would repeal the federal law that bans guns within 1,000 feet of any school.

After all, it was only after the Kohl-amendment outlawed guns in schools that schools became shooting galleries.

Prior to that, there had been isolated instances of school violence.  But, overall, ROTC students had marched back and forth across the campuses of America's high schools, armed with M1's -- and it hadn't occurred to anyone that they represented a danger.

Ninety percent of police officers, in a PoliceOne.com survey, agree that mass shootings would decrease if armed citizens were present to engage the shooter.

 

“Gun-free zones” don’t make places like Columbine free of guns.  They only keep the “good guys” from having guns.

Time to Redouble Efforts Against Anti-Gun Loretta Lynch!

Even if you have already done so, it is important to once again register your opposition to the nomination of Loretta Lynch as Attorney General, a person who could very well be in line to be the fifth anti-gun vote on the Supreme Court.

Lynch supports a renewal of the semi-auto ban. So a vote for Lynch is a vote to ban semi-autos.  Plus, she supports the President’s amnesty plan that will eventually result in millions of additional anti-gun voters.  No Senator who claims to be pro-gun should cast a vote in favor of her.

So please urge your Senators to oppose Lynch, and discourage them from siding with Harry Reid to cast the deciding vote to shut down a pro-gun filibuster:
