Ninth Circuit Affirms That It’s Illegal To Wear American Flag Shirts On Cinco De Mayo

 

It’s official: the U.S. Ninth Circuit Court of Appealshas issued an order declining a request for an en banc hearing in a case involving four students in at a California high school who were sent home for wearing American flag T-shirts on Cinco de Mayo.

The full slate of Ninth Circuit judges has thus agreed with a lower district court and with a trio of appellate judges that officials at Live Oak High School in Morgan Hill, Calif. could censor students who wanted to wear flag-emblazoned shirts.

The federal appeals court issued its denial of an en banc hearing on Sept. 17 — Constitution Day.

“[N]o further petitions shall be permitted,” the court ordered.

The trouble dates back to Cinco de Mayo (May 5) in 2010, when officials at Live Oak High — a school with a predominant Mexican-American student body — forced the students to remove their American flag-festooned shirts. Administrators called the shirts “incendiary” and worried that fighting would break out between white and Latino students if Latino students noticed the shirts. Students of Mexican heritage told local media that the students who wore American flag T-shirts should apologize. They said ethnically Mexican students wouldn’t wear a Mexican flag on the Fourth of July (not a school day, but never mind).

The high school, located 20 miles south of San Jose, has experienced numerous gang problems. Nevertheless, the school seems to have organized impressive Cinco de Mayo celebrations in recent years.

In the previous three-judge ruling, the Ninth Circuit held that school officials have wide latitude to limit freedom of expression.

 

“Our role is not to second-guess the decision to have a Cinco de Mayo celebration or the precautions put in place to avoid violence,” the court modestly observed. “Here, both the specific events of May 5, 2010, and the pattern of which those events were a part made it reasonable for school officials to proceed as though the threat of a potentially violent disturbance was real.”

Consequently, the court proclaimed, Rodriguez acted constitutionally when he told students to turn their American flag shirts inside-out or hit the road with an excused absence because he was trying to prevent potential violence.

The practice of limiting one group’s free speech rights because that speech might cause another group to react violently is known as a “heckler’s veto.” It is understood by free speech enthusiasts to have a chilling effect on First Amendment rights.

I wonder if the Mexican American kids could wear shirts depicting Mexican national flags during their 5th of May celebrations? Does the ban cut both directions? This I do not know yet, one way or the other. And additionally, why even have the 5th of May celebrations to begin with? Oh .... I forgot .... San Jose south is not in the USA anymore. I am not sure where it is. Maybe down that Rabbit Hole of Mr. Lewis Carol? Perhaps it is in Kommiefornika? That must be the place.

 

What I find most disturbing is the Courts seem pretty sure of them selves .... that elected or perhaps appointed school officials apparently have the power to ignore basic Constitutional guarantees...like the Bill of Rights. We have come a long way .... in the wrong direction. In 1966 I was President of the High School Rifle Club! Took rides in School Buses out to the rifle range .... loaded with guns! Can you imagine such a thing today? Had a small bore range under the football stands.

 

Things are getting very interesting indeed. Combine that with the possible .... er .... probable catastrophic economic collapse in the next 5 years and things will get very very interesting indeed. Maybe not so much for this Old Coot, but for my kids, grandkids and possible great grand kids. Things are not looking very good. The problem is that right now nobody in my greater family will listen to me spout about what is coming down the road. Something wicked this way comes .... fur sures.

It's time for the "legals" to start policing their own. If they want to be part of our country then let them prove their loyalty by speaking out and acting against this imminent threat. They won't, instead choosing to be part of the silent majority. Yeah, majority. Check out the census for California and you will see why it will never be a red state. Mexico always wanted California back and now the libs are handing it to them. Centuries ago when I was in high school, when a student or students were even suspected of causing unrest, they were hustled off to the office until a parent could pick them up and the suspension handed out with no protests. Usually the parent understood what trouble their darling little angel had gotten into and had to bring their contrite asses back to get them reinstated. I say we form a coalition of Adrian Petersons and supply an ample quantity of hickory switches and turn them loose. Sadly, the other side will be carrying guns.

On a lighter note, one of our school systems out here, the Auburn-Washburn school district #437 has had a full auto M-16 in their school inventory since 2008, even before full auto was legal here (except military and LE). Imagine that, but they only have one.

While the trouble makers are probably gang banging garbage, I don't blame the messican's for this one bit.  Their mentality is being encouraged by our elected to ensure they keep ther 200k per year job career.  It's certainly not their fault that the schools and the courts aren't willing to make the tough decisions which would no doubt lead to unrest.

 

Instead of being mad at the messican's, this should be a stern warning to pay attention to current affairs and to cast an educated vote every chance you get.

The 9th Circus has always been a leftist one packed with progressive activist judges who impose their idiocy on the rest of us.    If they want to celebrate Mexican independence days, let them go to Mexico.  This Cinco de Mayo is bigger here in the US than in Mexico where they celebrate their independence day on September 16.   Cinco de Mayo is more of the Mexicans kicking out the French. 

 

If these assholes are offended by an American flag then let the motherfuckers live in Mexico. The DemocRATs are using this to Balkanize us and are aided by the vermin in the media. I see the propaganda for illegal aliens on Spanish TV; Univision and Telefutura which are shills for DemocRATs.

This Cinco de Mayo is bigger here in the US than in Mexico where they celebrate their independence day on September 16.   Cinco de Mayo is more of the Mexicans kicking out the French. 

Cinco de Mayo is more about messican's (and American's) drinking beer.

 

Unless you're a trouble making douche bag to start with, I don't see why a messican AMERICAN would be offended by someone wearing a US flag shirt on any day of the year/
