It might be false bravado or unthinking explosion of thought but unless or until action comes from the words, it is still protected speech under our great constitution. The first amendment is only really needed when the thoughts expressed grate on someone else -- no matter who that someone else is. Freedom of speech baby! And that Terroristic threats, even out of context ones , can most certainly land you in deep water. Especially a threat on a high profile senator. And there is also who you're or how you're thought of. Ted IS that crazy rightwing whackjob who is expected to make outlandish statements/claims.
