Nevada SB175 with Amendment 136 passes- awaiting Governor’s signature!

Article by Blake Wheeler

While hope looked dim for several of the pro-gun bills to get through this Legislature Session, a revised version of SB175 has cleared both the Senate and Assembly and has now been presented to Governor Sandoval for his signature to become law.

Pushing this bill through couldn’t have happened without citizen involvement. These pro-gun bills were being used as a political football with some other issues, and were dead for all practical purposes. We got involved, YOU got involved, we ALL made calls/sent letters, and we got this done at the last minute! SB175 is a long way from completely restoring our constitutional rights, but it’s definitely a step in the right direction on several fronts.

Please stay involved! Let your elected officials know that you expect them to interpret the 2nd Amendment just as it was written– “the right to keep and bear arms shall NOT be INFRINGED”. This doesn’t mean just stopping future and further infringement- it means getting rid of existing laws that infringe on our rights. Infringe is a simple word, and we need to continue holding our elected officials accountable to clearly understand it.

Some of the positive highlights of SB175:

  • Defines the process and criteria to be used by Nevada when determining reciprocity of concealed carry permits issued by other states.
  • Makes the Nevada legislature the sole determining body on all matters pertaining to firearms, carry/transport of firearms, ammunition, and firearms accessories. Removes the ability of cities, counties, and municipalities to enact laws different than the state effectively ordering Clark County to stop their handgun registration program and destroy the records. Eliminates various city ordinances preventing open carry, such as those which currently exist in North Las Vegas and Boulder City.
  • Allows the use of lethal force to prevent armed forced entry into an occupied home or motor vehicle. A person is not required to retreat if they are not the original aggressor, has a right to be where they are, and is not actively engaged in criminal activity themselves at the time.
  • Removes civil liability for those employing lethal force within the law.
  • Officially recognizes that the right to keep and bear arms is protected by both the United States Constitution as well as the Nevada Constitution.
