I think the status as of right now is that the form 2 is in process. As it is being worked on out of state the ATF then must approve form 3. I then must fill out a form 4 to take possession. Is the firearm technically still owned by me right now? Does the ATF consider form 3 and form 4 change of ownership? I purchased the firearm in 2010 so I'm covered by the Q&A that says the purchase must have been completed prior to sanctions, but am not sure if I currently technically own the firearm or if it is technically a new firearm due to the form 2. Matthew Hopkins 1,065 Posted July 17, 2014 Report Share Posted July 17, 2014 (edited) boy oh boy, the way you did that it's like going from PA. to W.Va. by way of Ca. you've made it a lot, lot longer for yourself and a bit more expensive what you should have did was Form 1 to make it a SBS, wait the 9 or so months for the approval send then it off to have it made into a SBS and it would be sent direct back to you. the route you took, you sent a shotgun to a SOT to make it a SBS, when he completes that he has to transfer the SBS on a form 3 (tax free transfer) to a "class 3" dealer near you, which could take 4, 5 or more months for the transfer approval. then when the "class 3" dealer gets it, you come in and fill out a form 4 (transfer from him to you) send that off with the 200 dollars for the tax, then you have about a 9 month wait and no, technically that shotgun isn't yours anymore once it's made into a SBS. a SBS is a whole new classification firearm then what you sent him. it becomes yours when the form 4 comes back approved and the "class 3" dealer collects his "transfer fee" which could be anywhere from 20-100 bucks, and he gives you the SBS as for the sanctions part, that has nothing to do with SAIGAs that are already in the country Edited July 17, 2014 by Matthew Hopkins Quote Link to post Share on other sites

There's some technical legal term for it, but that Saiga-12 does still belong to you. You just can't take possession of it until it is registered to you, because stupid laws. You just can't take possession of it until it is registered to you, because stupid laws. that makes sense what you said there, but no matter how you slice it he won't be fondling, shooting etc... for about a year and a half. and I'm not counting the time how long it will take the SOT to get around to it. he might get it by next christmas S12 is one of the easiest things to SBS, providing you don't go making the barrel so short that you have to move the sight block back drill new ports etc.. it took me a whole 4 minutes to do mine, everything else was already in place, jI just cut the barrel to 13 inches Edited July 17, 2014 by Matthew Hopkins Quote Link to post Share on other sites
