Looper36 2 Posted September 23, 2013 Report Share Posted September 23, 2013 I am considering buying a 922r compliant converted saiga from a private owner. Do I need any type of paperwork? Do I have to register it? I am a pistol shooter, so I have to have a background check and have to register my firearms. I have searched and read till my eyes cross. I have not been able to find a definitive answer. I'm not sure if there are any legal differences between sporting and non sporting. I don't want any issues with the ATF. However, I would suggest talking to someone in a local gun shop in case there are any local or state laws to consider, but on a Federal level you should be fine. poolingmyignorance 2,191 Posted September 23, 2013 Report Share Posted September 23, 2013 Simple things to keep help weed out problem Sellers/buyers, is ask for Bill of sale, and to verify Drivers license, or even better a CHL. Ask the seller specific barrel length (anything over 16" is good to go). I don't know Florida law on face to face sales, so do some research and remember "I heard so on the internet" won't hold much water in court. Quote Link to post Share on other sites
Matthew Hopkins 1,065 Posted September 23, 2013 Report Share Posted September 23, 2013 (edited) barring any weird Fl law about private sales, from a private individual, check his drivers license to make sure he is also a resident of your state and that he is over 18 years old or older, you should also show your DL so that he knows he is selling to a resident of the same state, and that you are 18 years old and over, if it's a pistol both of you have to be 21 years old and older. that is all the legal requirement there is. this is what I do whenever I sell or buy firearms face- to face, this isn't mandated by law but a CYA for me. I get the name and address from the guy, and I offer to let him write down my name and address, if he wants. then I record where and what date I bought or sold that firearm. ie AKRON GUN SHOW, 19 Sep. 13. Looper36 2 Posted September 23, 2013 Author Report Share Posted September 23, 2013 The S12 I intend to purchase is currently owned by a forum member and the conversion was done by a well respected gunsmith here on this forum as well. The weapon has not been altered since it's conversion. I checked with my buddies at my local gun shop, they assured me there would be no legal issues in my state and/or county. The face to face is based on the fact that the seller is within driving distance. I will ask for any and all paperwork on it. I posted my questions here because this is a huge knowledge base and the members here may pose questions that I forgot or didn't think to ask. The seller is a regular Joe and is not a FFL licensed dealer. He is selling it to finance a new build. I appreciate all your help. Thanks. Quote Link to post Share on other sites

If somebody later shows up and claims that it is stolen, and they are the rightful owner, the bill of sale with the seller's name and signature gives you some legal protection. I would walk away from any sale where the seller was not willing to provide one. All it really needs to have is Item XXX serial number XXX sold to buyer XXX by seller XXX on such and such a date, etc. It's just a common courtesy as far as I'm concerned.
