HB of CJ 1,263
If President-elect Trump is still President-elect and NOT YET POTUS, how can he nominate key cabinet positions? And how can the Senate be now subjected to confirmation hearings? He ain't prez until 20 Jan, 2017. What's going on? That is not what the Constitution says? I thought you had to be the President to do this. Yikes!
ChileRelleno 7,071
Every President elect does the same, they have to have at least the core of their administration ready to go to work on Jan 20. This isn't new, unusual or unconstitutional. This IS the next POTUS and he needs his Admins in place.
HB of CJ 1,263
Preselect certainly. But confirm only after he becomes President?
DLT 1,646
I still laugh when I remember the fools over at CNN the day before the election talking about how Hillary and her team were already working on their cabinet picks and transition.

HB of CJ 1,263
Steering this back on topic. The Constitution says "President". It does not say president-elect. Obama is still the president. Not Trump. Trump can select folks all he wants but he must wait until after he is sworn in before the Senate can CONFIRM. Important? Oh yeah!
ChileRelleno 7,071
The actual confirmation and swearing in is not done until the day of Jan 20th, or thereafter if the nominee is still under scrutiny.
HB of CJ 1,263
Chile. Correct. But how can the Senate CONFIRM a cabinet position BEFORE Trump is sworn in? Or are they going to wait to confirm until after the swearing in ceremony? Or can they kinda confirm before but do the actual confirmation after the ceremony? Not quite the same thing. ChileRelleno 7,071
Read it again... Yes, the actual and official confirmation and swearing in is done on Jan 20th or thereafter. The Senate may vet and acknowledge their intention to confirm before that, but it isn't official. The ball is set rolling on the nominees literally the day after the election since the actual electoral college vote is for all intents merely a dog and pony show.
HB of CJ 1,263
Final Partian (sp?) shot. So why does all big and little media call it confirmation hearings? Why do the actual Sinisters ... er ... Senators call it confirmation hearings? Seems to me "consideration hearings" would be more accurate? When it comes to the US Constitution we must hew to the line and let the chips fall as they may. Thank you.
Remek 771
Sadly, and I hate to point this out, the government doesn't follow the constitution unless it's convenient for them. They have it in tatters and only when we beat the shit out of them will it change. Let's hope Trump brings some brass knuckles. We will know his intent, just like Barry's, when he does, or doesn't, go after Barry. (Barry constructively announced his intent to ignore the constitution when he didn't go after Bush.)
HB of CJ 1,263
Well it is all moot now. And it does seem the actual confirmation vote takes place AFTER Trump becomes President.
