The catch is, if you're not read your rights, and you talk to the police at the time of arrest, that information is not admissible in court. In most arrests, Miranda is not read. It is not necessary because there is no questioning needed. Hollywood likes to make it seem like police whip out a card and start reading Miranda as soon as the cuffs go on, but this is just not reality. If questioning needs to be done, then Miranda is read and most of time given to the person in writing, at which time they either sign the waiver or they don't. Miranda rights only apply if you are in custody AND being questioned. Miranda is not a given right upon arrest, but rather a protection after arrest and before questioning. It's an inalienable right. The reading is simply to assure the average idiot knows it before he harms himself. The courts put this in effect when they realized idiots were being taken advantage of.
