A New York father has had his firearms all but confiscated after the Suffolk County Pistol License Bureau suspended his pistol license indefinitely over a perceived threat made by his 10-year-old son and two of his classmates at school.

John Mayer, of Commack, N.Y., told TheBlaze that the incident occurred on March 1. It was like any other day, the father explained. He put his son on the bus and sent him off to school.

Later that day, Mayer got a call from school officials at Pines Elementary School informing him that his 10-year-old son and two other students were talking about going to a boy’s house with a water gun, “paint gun” and a BB gun. There had reportedly been a school yard pushing incident the day before involving the boys, excluding Mayer’s son, and they were seemingly talking about getting even in some way.

Mayer told TheBlaze that a teacher overheard the students talking and informed the principal, who then immediately called police and filed a report. He said the principal told police something to the effect of, there’s a “kid with a gun, ready to go.” Mayer maintains that no serious death threats were made by the students. The Hauppauge Public School District has not returned several messages left by TheBlaze, therefore, it is not clear what they are claiming was said.

School officials then “interrogated” the boys, Mayer explained. It was later determined that the 10-year-old boys did not have access to a BB gun, paintball gun or any actual firearms.

 

The school’s principal later informed the father that his son would be suspended for two days for the incident. But the ordeal was far from over.

Mayer said police officers were then deployed to his home where he was advised by officers that they might have to confiscate his firearms, which he says were all properly stored and secured. “I just couldn’t believe what was happening,” he told TheBlaze.

The following Monday, Mayer got a call from the Suffolk County Pistol Licensing Bureau. He was reportedly told that his license would be suspended and police would arrive at his house the next morning to retrieve his handguns. Acting quickly on the advice of his attorney, Mayer transferred all 15 of his handguns to his friend to prevent them from being confiscated. He also transferred his long arms to a local gun store out of fear that police would attempt to confiscate them as well.

However, that hardly fixed the problem.

Mayer’s pistol license has been suspended until further notice and he says officials have informed him that the suspension could last until his son moves out of his home. His son is only 10-years-old, meaning it could be eight years or longer before his license is restored.

“All my handguns are gone,” Mayer said, letting out a sigh of exasperation.

“We’ve grown to such an absurd point now with firearms where kids can’t even be kids,” he added. He also brought up the fact that there are now students getting suspended for pointing their fingers like “firearms.”

A spokesperson with the Suffolk County Police Department told TheBlaze that the incident is still under investigation.

“The Suffolk County Police Department Pistol License Bureau is conducting a complete and thorough investigation into the matter. Based upon the investigation, his license has been suspended,” the spokesperson told TheBlaze in an email. SCPD declined to provide any additional information.

Mayer’s lawyer, New York firearms attorney James Murtha, told TheBlaze that Mayer does not have any history of mental illness or criminal behavior. He also noted that Mayer’s son does not have a history of violent behavior.

“We understand that in this day and age things can get perceived wrong,” Murtha said. “But we are talking about a child making silly comments. And now a man’s constitutional rights have been dramatically violated.”

Gun rights “mean nothing at all in New York,” Murtha lamented. “Firearms are thought to be some really evil thing here.”

In New York, he explained, a citizen can be a denied a pistol license if the pistol licensing department determines that person doesn’t have “good moral character,” an undefined term:

Eligibility requirements for the issuance of a pistol license in New York are set forth in Penal Law §400.00(1). Briefly, an applicant must (1) be twenty-one years of age; (2)
of good moral character
; (3) have not been convicted of a felony or serious offense; (4) state whether he has ever suffered from mental illness or been confined to an institution for mental illness; and (5) not had a pistol license revoked or who is not under a suspension or ineligibility order issued pursuant to CPL 530.14 or Fam. Ct. Act 894-a.

“A clear message has to be sent that the government can’t treat citizens this way,” he added. “Firearms are not frightening. Not a single one of my firearms has ever put on a pair of shoes, run down the street and killed somebody.”

Mayer is now pushing for New York to adopt legislation similar to Maryland’s S.B. 1058 or the “Reasonable School Discipline Act of 2013.” He says it would protect the rights of students and parents.

The legislation prohibits a principal from “suspending or expelling a student who brings to school or possesses on school property a picture of a gun, a computer image of a gun, a facsimile of a gun, or any other object that resembles a gun but serves another purpose.”

The bill also prohibits a principal from suspending or expelling a student for making a “hand shape or gesture resembling a gun.” The law does, however, reinforce a principal’s right to discipline students for performing “a direct act of violence against another student.”

Mayer first brought his story to the popular firearms website LongIslandFirearms.com, where he is a respected member, according to the site’s operator. The website is currently accepting donations to help cover Mayer’s legal fees.

Because we have not heard the police or school officials’ whole side of the story, this story may be updated. TheBlaze will continue monitoring and investigating this developing story.

Why would anyone be suprised by any actions against citizens of New York??? There is no limit to the madness when you have people like that in office.

 

I will just simply say, You should have drawn the line way before this. Maybe when they tried to control the size of soft drinks.

 

That kind of BULLSHIT wouldnt fly down here in "hickville" Texas. Change it or move.

 

I worry that there are too many left leaning thinkers in the US now and our only option is to divide the US.

 

 

 

P.S. This is not directed at the OP. This is directed at New York residents. I know there are alot of good residents on the forum that have tried to stand up to this shit, but I fear you may be out numbered by the sheep.

Suffolk County Pistol License Bureau......this is the problem right here. When did the good people of NY allow this to be done to them? It is obvious that the rights of NY'ers went out the fuken window long ago, I never heard of a Pistol License Bureau, I really didn't know such a thing existed....fukme amazing.gif

Is it possible that people didn't see their elected officials ever doing this to them? I guess I should say that many people know that this is the first of my 46 years of life to vote. It was a great let down and I wasn't missing anything, haha... Anyhow, I think that there are a lot more people out there like me that really don't understand politics and especially when it comes to election time, there are so many different slaughter commercials that a person not in the know has no clue who to vote for.

 

I had other interests aside from firearms in 94 so I can't say that this really effected me. But, I will honestly admit at this point that i don't make the time to keep track of everything, so the gun issue is the only reason I have at this point to vote. To some of you, that makes me a bad person I guess. Doesn't do me any good to vote if I don't know WTF I'm doing though. I don't understand the districts. What impact if I have, if any if my district is a given for a certain person. And WTFing hell is an elctoral college (rhetorical question) It all seems like a rigged pile of shit run by money.

 

So... Here's my point. Is it possible that there are many people like me that care but don't understand the bull shit and don't know where to start. So they either make a bad vote just placing a check mark by the person with the coolest name. Or they don't vote at all. Which leaves the vast majority of votes to the people of wealth that use this venue to control things by way of contributions and other IMO underhanded ways.

 

My neighbor is an avid gun owner and has no fucking clue what the new laws mean. I think the vast majority in CO don't know what current laws mean as they own a gun or two but are not "into" them and think that since they don't own an AR15 that the laws won't effect them which couldn't be farther from the truth.

 

I dunno, just kinda how I feel. I know I'm a political dumbass but I see people say how can you let this happen to your state and being in my position I understand how. Not being politcally involved. Many of you guys here can predict the gawd damned weather by politcs and I envy that knowledge.

 

Maybe helping educate in some way dumbasses like me will help the cause more than any letter writing will do. Make sure your friends and family know who, what, where, when, and why. Then they can help their friends and family and so on...

 

So just maybe the next time you see a post where someone is obviously uneducated... Being a little more tolerant and getting them the info they need without making them feel like they let their country down would make them feel more comfortable asking more questions that will lead them to an educated vote.

You seem like a hell of a guy from what posts I have read of yours and by your honesty in this post. I am a lot like you when it comes to politics and voting. I was asleep for the most part, and now that my guns are being fucked I am pissed. I also have not voted alot in the past and this last 5 years has been a real awakening. I am lucky that I live in Texas. I am now however going to make damn sure I know where people stand on issues important to me and let my voice be heard at the voting booths.

 

I have faith that 2014 will rid us of some of these assholes, but not all of them.

 

Sorry if I came off as judging you personally, I have no right to do that and that was not my intent.

It appears that you have taken another of my posts personal. Please note that I was simply responding to the OP. Also, as I learned something new about NY law, I was asking an honest question..."Suffolk County Pistol License Bureau......this is the problem right here. When did the good people of NY allow this to be done to them"? As in how long has this law existed? It might appear from this question that I'm not exactly the brightest bulb in the box either.

 

Where have you been, AA? Several states require some type of "permit" or ID card to "allow" their citizens to buy pistols.

I have never heard of such shit, I guess I've enjoyed more freedom all of my life than alott of other folks have.

I'm not your enemy, I'm really sorry that your freedom has been stolen from you, and when I say things like I cannot understand why people would continue to live that way, it is not that I think badly of you, it is because I refuse to live like that. I argue with people on the left all the time. I am getting tired of defending my gun rights to people that don't even own guns.

 

I had a thought the other day and it boiled down to this:

 

These people pushing the laws won't acknowledge that the 2nd amendment was written to protect us from a tyrannical government with the use of our guns. This is a very simple fact. No thoughts of hunting, limited mag capacity, etc..

 

These people are either to stupid to realize that or refuse to acknowledge it for their own agenda.

 

Both of these reasons mean one thing. They don't belong in office and they should be considered terrorist's.

 

It's that fucking simple.
