California converted Saiga owners BEWARE!

There has been lots of problems with BLM shooting ranges in California confiscating guns, and even trying to prosecute owners. BLM seems to have some special unit that gears up like spec ops comandos to mess with law abiding citizens at their shooting ranges. They specificaly target "evil looking stuff". I was approached by these guys at a range outside of Ridgecrest and they wanted to take my Saigas and AKs, luckily I was shooting with my Sherriff buddy who told them they are full of sh!t and I ended up just leaving the range with my stuff. About a month or so ago at the same range, these BLM "commandos" confiscated a guys AR build (built by a local CHP officer as a gift) and tried to prosecute. The Kern County DA refused to prosecute him, but sent his gun away to the DOJ. Lots of similar stories coming out of cali, I just happen to finally almost fall victim.

 

FYI: These are NOT California LEO doing this, this is Federal BLM employees! You know, the ones that used to put out wild fires and issue off-road permits.

Now im all for LE don't get me wrong. I have family and friends that are LE, and im testing in october for a job with our local corrections.

I just ask myself and others how much of this liberal anti gun BULLSHIT are we going to take?

Everybody knows what happens when someone is backed up in a corner. That person has no choice but to come out fighting for their lives.

Im surprised they not just goind door to door asking for your guns in that fucked up state...

I just thought that I would share, that under the patriot act, ANY firearm that LEO lands hands on and takes, EVEN IF THE OWNER IS NOT BREAKING THE LAW AT THE TIME, once they have it in thier hands, they do NOT have to relinquish it.

 

Someone with more time, patience, and money SHOULD be able to win a large civil suit against a court that decides to do this, however. I myself, just wanted to be done with the whole thing, and wound up packing up and leaving.

 

I think the best part of that whole thing (I ranted about that a couple years ago on here, and its been tossed since then) was when myself and my mother were in the side chamber to the court while it was in session, having it out with the local cops, then re-entiring court to a silent town, with the entire police force wide eyed with hands on thier sidearms! And yes, it was thrown out.

 

But they never gave me my guns back that they took illegally. I was even told through a lawyer that the DA knew that I would win a lawsuit, but they would make it take years and years, and cost me tens of thousands of dollars.

 

I have a lot of faith in the officers, but not the courts that those same officers work for.

 

The only suggestion that I have, is to do what I did, and come election season, go full balls on supporting opposing pro-gun local candidates for office, and have them put into office. It all starts at the local level, and if we dont combat it at that point, when it is still sprouting it's socialist liberal and facist seed, we are going to regret our inaction some day.

sure, if you want to help me recoup some of the 4 grand I spent on that case, Ill go dig in the lawbooks and give you copies of the crap.

 

I really am sorry to be snide about it, but I still have a bad taste in my mouth from that whole affair, and also am tired of digging up laws for people that question what I am saying, even though I have seen it first hand, as in this case. Yeh, I know, the law in all states have provisions and time tables for handing over firearms to various caretakers and such.

So, what you are saying is that no, it's not a provision of the Patriot Act, no, it's not even legal at all... In fact, it's the actions of a corrupt DA and PD... but you are still going to blame it on the Patriot Act?

 

Honestly, you should have sued the town. You could have found a lawyer to take the case pro bono. It's pretty open and shut. They must return your property. Tack on compensatory damages, and add your legal fees to the demanded injuries. If the PD did actually refuse to return your property to you, you could have made yourself and a smart lawyer quite a tiddy fee.

 

Oh, also. Unless you want to look just as much like a lieing schmuk as the DA and PD who stole your property, stop claiming the Patriot Act gives them the authority to do so. You don't have to put on the act about "digging up" anything. It's not in there.

I couldn't find anything about LEO's right to confiscate legally owned weapons from US citizens or residents under the provision of the Patriot Act. I would think NRA would be very vocal about this issue.

 

Bvamp, I'm really sorry about your ordeal, I can understand how one might feel when the government barges into their life like that as I grew up in the former Soviet Union. If you happen to talk to your neighbor, ask him which part of the Patriot Act allows for such a blatant violation of our civil rights.

 

I tried to skim through the PA, but couldn't find anything of relevance. I hate reading legal stuff as they always use references to other things that you have to know in order to follow along.

Our girly man governator is the same one that signed the bills to ban lead ammo in most hunting area of Kallyfornia. This was to protect the Condors, you know the same glorified buzzards that were too dumb to fly away from the recent wild fires out here. And he's also the same one who signed the microstamping bill that will scare away many hand gun manufacturers here in the PRK. And he's the same one who also signed the bill banning 50 cal rifles, you know the ones all the gang bangers use...LOL He's another big dissapointment to law abiding gun owners. He is a fraud

Go open the gigantic federal law book that I was handed and that I read it in, and find it yourself, or you can PAY ME for my time and effort.

This is why i live any iowa, don't shoot the neighbors cow and it's all good. No peoples republic of NY or california to deal with. Our govenor is no gun guy either but he has his hands tied with other things. And no offence to bvamp but i would have sued the city and the local PD for a tidy sum of money. I'm sure there would have been a lawyer to take the case.

Just my to cents, and why i decided not to move to hawaii after a vacation there because of their gun laws. No high cap magazines and no 50cal. :cryss:

You can have a .50 bmg in Hawaii. You just can't shoot it at the state owned range. The PD and military use the state range to practice when the range is closed to the public and some soldier fired a .50 over one of the mountains and the round hit a house on the other side. Ever since then, the state banned .50s from the range. We've heard you can still shoot them at the military range, but we've never confirmed that.

 

What sucks more than the .50 cal issues is no NFA here.

Hey I said I could get the 300$ gun back. I also said I was informed via proxy that the DA intended to make it take years and loads of money to do so. I also pointed out that the local PD had begun harrassing me. I may or may not have ALSO stated that I moved out of that jurisdiction about a month later.

 

 

It was a combination of THREE pieces of law, all in separate parts of penal code both at federal and local levels. The one that was shown to me by my aforementioned neighbor, was in fact part of the patriot act that the shithead DA quoted in court.

 

After being spoken to rudely outright, I think Ill leave it to you fine fellows to find out how they fucked me over. I already know, and Im not going through thousands of pages of laws to recover proof for someone on the internet.

 

I will note that I joined the NRA about a month after my case was expunged.

 

 

I will also tell you all what I learned. Dont EVER call the police for help. Handle the situation yourself, and let them come if they have a problem with it. NEVER allow entry into your home by ANY member of the court, including the PD. Dont even let them on your property, and dont believe their bullshit reasons for it, either. You can hear the nice officers quite fine while they stand on the TOWN's road, and YOU stand INSIDE the variance (normally 8-10 feet) on your property.

 

Oh, and IMMEDIATELY press criminal charges on whoever you can, and SEE WHAT STICKS. Be sure when the case is expunged, to get a copy of the court documents and IMMEDIATELY follow a civil rights lawsuit.

 

If you want to know the law, hire a lawyer like I did.

This was passed in response to what happened in New Orleans and was signed into law by President Bush. Suggest you print out a copy and keep it with your guns. :) Rules is Rules and The Law is the Law. It might come in handy one day.
