Georgia Legal Question... involving crappy neighbors

I live in a older neighborhood, next to a aged couple who have pissed everyone off in the entire place. They are 60ish, the woman is a hard core alcholic who has picked fights with everyone in the neighborhood and pissed off everyone unfortunate enough to encounter her, and the man is a spineless jellyfish who aids and abets her in her drunken fits.

 

I would guess our houses are maybe 60 ft apart. These people always kept the shades and curtains drawn tight, as if they were worried about bombers overhead, but lately I noticed the window directly facing my house isn't getting this treatment anymore. This is so unusual it drew my attention, and what did I find? Well these despicable shits now have a video camera pointing at my house 24/7. Almost directly at my living room window.

 

Do I have any legal recourse here in Georgia? Is this invasion of privacy, stalking, or some other such? I would love to just knock the window out and smash the damn camera, but cooler heads need to prevail here....

1:Check in with the Local Georgia PD and file a complaint.

2:Erect a well built privicy fence. Also adds value to your home.

3:A 5mw laser directed thru a magnifying glass and directed into the lense of their camera would make their new home video's a little on the red or green side, works great with or without the magnfiying glass, but may be viewed as illegal in some areas. in ex. might blind someone who might be looking at your house, or as I found out really scared the Sh!t out of my neighbors who thought their crank house was under a raid by the police. he he..

Sorry buddy, there is no Georgia criminal law against it, unless it is pretty new.

 

You might have some civil remedy, but that it outside of my personal knowledge.

 

On the other hand, do you have kids? How do you know they are not filming your and neighborhood kids? That might be worth an inquiry…

 

You could also try an IR laser aimed back at the camera. You can buy the IR diodes on eBay, 1-5 mW should do it.

 

You might also consider one way Reflective film for your windows facing their home. Or pull your curtains.

 

 

 

Also, the next time she makes a drunken ass out of herself with you or a neighbor, try and make sure that she is in the sweep of her own camera. When the cops arrive, tell them that there is a video of the encounter and let them seize the tape for evidence.

Thanks for the responses guys. Azrial, I was worried there might not be a law against this. We do keep the blinds shut and curtains drawn after dark on that window, but it's really just the thought of these miserable wretches spying on me and my family that sets me off.

 

That bitch has had the local police called on her at least 3 seperate times in the last few years for picking drunken fights with some the elderly residents around here. My Mother (who was in her late 70's at the time)was among those she verbally assualted, and because of that a privacy fence was erected in our back yard facing their property, but now I see I probably should have went all the way down the damn property line with it. The hag now confines her drunken episodes to her own yard out of sight, but the entire neighborhood loathes these human cockroaches.

 

The laser idea might just work though, especially if I can find a IR one to use. Those morons probably think infrared is the color of paint at Home Depot... :haha:

This may sound silly but can you grow bamboo? When I was a kid, my dad grew this really tall bamboo along our back fence and that stuff grew really high. It will completely block the view from your neighbor.

I'm not positive, but it might violate some invasion of privacy law.. Doesn't sound legal to me but if Azrial says it's legal I would follow his advice. If someone did that to me I can't say I'd stay within legal limits though with 100% certainty.. I'd be furious

Unfortunately, Azrial was right and there is no law against anyone using a video camera on their property regardless of which direction that it is pointed. But, you can always have someone take a picture of your bare butt, blow it up and stick it in your window facing them :lolol::lolol: If they complain about it and anyone asks, you can always just call it contemporary art.

 

On a serious side and much less expensive than a full fence, I would look into the mirrored tint. I'm pretty sure that you can pick some up at Lowes, Home Depot, etc. The stuff works and goes on easy.

 

Now for the lawful side of things. You do have one recourse, but it will take some time. Everytime she makes a clown out of herself in one of her drunken or abusive manners, contact the police and have them respond. Most agencies will complete a report at your request and your right. If the officers are capable of pursuing a Disorderly Conduct O.C.G.A. 16-11-39 charge against her, they will and can list you or another neighbor as the complainant and the state will be listed as the victim. If they can not make an arrest at that time, then the incident is at least documented. Advise your neighbors to do the same and ask for a documented report with an assigned case number. Now comes the fun part and it involves a code section that few Georgia officers use or even know about. The code section is O.C.G.A. 16-11-44 Disorderly House and reads "A person who keeps and maintains, either by himself or others, a common, ill-governed, and disorderly house, to the encouragement of gaming, DRINKING, or other misbehavior, or to the common disturbance of the neighborhood or orderly citizens, is guilty of a misdemeanor."

 

The charge is valid and will hold up in court. I have used this charge several times when I have to repeatedly respond to the same residence for domestic disturbances and such over and over and over and over again (you know the ones that intentionally pick fights with each other and then contact the police because they start losing the argument). The charge is arrestable either with a trip to jail or release on a citation. Either way, they will get the message that the neighborhood is fed up with their actions and will take no more. That is why it is important to document each instance with the police and obtain a case number. After two or three reports, there will be enough documented instances of a neighborhood disturbance and it will make the charges easier for the officers to enforce. They can just reference the previous reports in the arresting report. Everyone thinks that they can do whatever they want to do without any regard for others until you start hitting them in the pocket book for fines or bail.

Why wouldn't it be legal?

 

You have the right to set up video cameras on your property to film any thing and any direction you like.

 

Anyone in line of sight has the right to use curtains, drapes, mirrored window tint, bamboo along the fence line, etc to keep you from watching. .

 

 

Now when the photographer enters your property to film you - THAT's when the law jumps on to your side.

just for shits and drunken gigglz, i'd call the cops saying you believe that they are pedophiles attemping to videotape your children. Whether it's true or not, it'll get the attention of the police and themselves, and maybe the camera will disappear, if not...i'd print that picture out and post it up for them. You never know, the old hag might be masterbating to that picture above...

Thanks for the encouragment guys!:) Had a minor development today.

 

I came home for lunch today as always, and on the way back to work drove past the front of the shitbirds house. Well, they are having some work done to the place, and they were sitting out front like two old stoned geezers, watching the carpenters work and eyballing everything that moved on the street. I pull even with their place and of course they do the damn turkey neck and start staring at me.

 

I give these two my best eat shit look slowing down as I drive by, and when I get even with them I start shaking my head slowly back and forth in the universal "NO" motion, as a sign of my disgust with them. This evening after dark I was out in the yard with my dog and noticed the camera was no longer in the window. :eek: I wonder if they figured out how pissed I am? If they moved it there are only a couple of other possibilities and eventually I'll spot it again. But who knows, I'm keeping my fingers crossed the shits have decided it isn't the smartest move on their part to continue spying on me and my family! :devil:

How about running million candle power spotlights to their windows where the cameras are if they start back up?

Say that your worried about night prowlers & this is the only light you have. :devil:

Get a cheap 12 volt million candle power spotlight for cars & a 12 volt AC adapter from goodwill so you can plug it into the wall.

It would send a message & make it impossable for the camera to film. If you put it right against the glass at night, you wouldn't even see the light yourself.

 

There are now laws about light pollution are there?

 

They are probably tweekers & saw your S-12 :chris: so they think they are surveilling you.

 

You can send this guy over to "chat" with them.

NO,NO,NO,NO!! I have been battling the DAMNBOO for the whole 15 years I have lived in this house. It takes more time and effort to keep this 'little shop of horrors' alien invader from completely taking over. The root system will cross under a 20' wide driveway to find new space, and this crap thrives on Roundup! So far the most effective weapon I have used is a backhoe. And the root system gets so massive you have to take small bites and shake the hell out of it, or you will just stall the backhoe!

Well your problem is solved...GREAT hopefully it over...but my idea was to parade one of your naked children in front of the camera then close the blinds...then call the police and report it and say you only noticed the camera when you were closing the blinds. Then you can get mad and pissed when the cops show up...Child porn or peeping isn't PC anymore.

In indy the laws are the same. It often freaks people out that things that would seem to be illegal aren't. If the female is always drunk, as long as the police see her on public property, street/sidewalk she can be locked up for P.I. If their house is a rental, call the police and eventually they will force the landlord to evict them. In indy we have a law called maintaining a common nuisance which is basically a house that the police are sick of going to because everyone acts like a jackass all day long.

Though it may not be illegal, do you live in a subdivision with a HOA? If your drama continues, read through the covenants and see what you can find anything about their house or yard that may be a violation. Hedges too tall? report it. Grass not cut? report it... etc. Just keep doing it and making them get those letters may be a nice "behind the scenes" way to pay them back. My subdivision is notorious for sending any fine they can, and yours may be willing to pursue fines for some violation of the HOA covenants.

Neighborhood associations suck balls.

 

You can't have a project car, boat motor home or travel trailer if it is at all visible.

 

Yeah... That's just what I want... To pay out the ass for a house, & still be treated like a renter with some blowjob telling me what I can & can't do on my own property.
